1. The agreement
These terms are between you (“you” or the “Customer”) and the operator (“we”, “us”), and cover the Ember Studio service at (the “Service”). By creating an account, or by using the Service, you agree to them and to our Privacy Policy. If you are using the Service for a company, you confirm you may bind that company. You must be old enough to enter a contract where you live, and use the Service for business purposes.
2. The service
The Service helps you improve how a local business appears in search. It includes:
- Image optimisation - it reads photos you upload, uses an AI vision model to write titles, descriptions, alt text and tags, embeds that metadata (EXIF, IPTC, XMP, and optionally GPS coordinates) in the files, and converts, renames and compresses them.
- GBP Optimizer - it can read the public details of a Google Business Profile from a link you provide, score it, and use AI to draft categories, descriptions, services, posts, polls, questions and answers, and review replies around keywords you choose; it also lists business directories where you may publish your listing, and can check ranking positions.
- Reports, exports and, on some plans, an API and a local runner that processes jobs on your own computer.
Each plan has monthly allowances (for example images, AI generations and live lookups). Allowances are hard limits: when one is used up, that feature waits until the next period, or you upgrade. Unused allowance does not roll over. Where a plan lets you connect your own AI key or data-provider login, you are responsible for that account and its charges.
3. Your account
- You must give accurate details, including a working email address and a phone number with your country code, and keep them up to date.
- You may sign in with an email and password, or with Google, Facebook or Apple. You are responsible for everything done through your account and for keeping your credentials, API keys and devices secure. Tell us promptly if you suspect misuse.
- One person per seat. Do not share a login between people.
4. Your content
You keep all rights in the images you upload, the business information you enter, and the text and metadata generated for you. You give us only the permission we need to store, process and return that material to you, including sending it to the AI and data providers described in the Privacy Policy so the Service can work.
You confirm that you have the right to upload each image and to use the results, that you may manage or have permission to analyse any Google Business Profile you import, and that none of it infringes anyone's rights or is unlawful.
5. Acceptable use
- No unlawful, infringing, deceptive or harmful content - including fake reviews, false claims about a business, or misleading location data.
- No attempt to get around allowances, rate limits or access controls, or to interfere with the Service or other customers.
- No reselling of raw access to the Service or its API as a competing product without our written agreement.
- No use of the profile import, ranking or directory tools to scrape data at scale or to breach the terms of Google or any directory.
We may suspend or limit an account that breaks these rules, after warning you where that is practical.
6. AI output, rankings and results
Titles, descriptions, categories, posts and other text are AI-generated suggestions and may contain mistakes. You are responsible for reading and approving everything before you publish it, and for making sure it is true about your business and complies with the rules of the platform where you post it (including Google's Business Profile content policies).
Search rankings depend on factors outside our control, including decisions by Google. We do not promise any ranking, traffic, calls or revenue. Audit scores and rank positions are estimates from third-party data at the moment of the check. We are not affiliated with, endorsed by or sponsored by Google, Facebook, Apple or any directory named in the Service.
7. Third-party services
The Service works with services we do not control - AI providers, a business-data provider, payment processors, blockchain networks, sign-in providers, geocoding services and the directories we list. Their availability, prices, terms and privacy practices are their own. Directory links are provided for convenience; a directory may change its address, price or rules, or reject a listing, without notice.
8. Plans, prices and card payments
- Prices are shown in US dollars and, unless stated, exclude taxes. Where our payment partner acts as the seller of record, it collects and pays the applicable taxes and its own terms also apply to your purchase.
- Card subscriptions are billed in advance, monthly or yearly, and renew automatically until you cancel. You can cancel at any time in Plan & billing; the plan then stays active until the end of the period you paid for and afterwards moves to the Free plan.
- A free trial, where offered, ends automatically; unless you subscribe, the workspace moves to the Free plan.
- We may change prices or plan allowances for future periods. We will tell you in advance, and a change never affects a period you have already paid for.
- If a payment fails we may retry it and, after a grace period, limit the workspace until it is settled.
9. Crypto payments
Where crypto is offered, you can pay with USDT on the TRON (TRC20) network, sent directly to the wallet address shown at checkout. Please read this carefully, because blockchain payments cannot be reversed.
- Only USDT on TRC20. Tokens sent on any other network, or a different token, will not be credited and cannot be recovered by us.
- Send the exact amount shown. The amount includes a few extra cents that identify your payment. A different amount cannot be matched automatically; contact support with your transaction hash and we will review it.
- Network and exchange fees are yours. Some exchanges deduct their fee from the amount sent - make sure the amount that arrives is the exact amount shown.
- Payment window. An invoice is open for the time shown at checkout. If your payment arrives shortly after it closes we will still honour it, but we cannot guarantee that for later payments.
- Prepaid, not recurring. A crypto payment buys one month or one year of the plan. It does not renew by itself; when the paid period ends the workspace returns to the Free plan until you pay again. Paying again before then extends the same plan.
- We verify payments by reading the public blockchain. Activation normally follows within a few minutes of confirmation, but network delays are outside our control.
- You are responsible for the wallet or exchange you send from, and for any tax that applies to you on the transaction.
10. Refunds
Fees are for access to the Service during the period paid and are not refundable for a partly used period, except where the law requires it or our payment partner's terms provide otherwise for card purchases. Crypto payments are final because they cannot be reversed; if we are unable to provide the Service you paid for, we will work with you on a fair remedy, such as extending your plan. If you think you were charged in error, contact us within 30 days and we will investigate.
11. Data retention and deletion
Images you upload and the files we produce are kept for the retention period of your plan (between 7 and 180 days, depending on your plan), and then deleted automatically. You can delete a job, and with it its files, at any time. Text generated by the GBP Optimizer, imported profile snapshots and your account records are kept while your account exists. Deleting your account removes your content; records we must keep for tax or legal reasons are retained as the law requires. You can export your results at any time; download what you need before its retention period ends.
12. Warranties and liability
The Service is provided “as is” and “as available”. We work to keep it reliable, but we do not promise it will be uninterrupted or error-free, and we exclude warranties that the law allows us to exclude.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, rankings, traffic, data or goodwill; and our total liability for anything arising from the Service in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
You agree to cover reasonable losses we suffer from a third-party claim caused by content you upload or by your breach of these terms.
13. Ending the agreement
You may stop using the Service and close your account at any time. We may suspend or end an account that breaches these terms, is used unlawfully, or has an unpaid balance after the grace period. When an account ends, your right to use the Service ends, and sections that by their nature should continue (such as liability, payment obligations and governing law) continue.
14. Governing law
These terms are governed by the laws of the country in which the operator is established, without regard to its conflict-of-law rules, and disputes go to the courts of that country - except that nothing removes any consumer-protection right you have under the law where you live. Please contact us first; most problems can be sorted out quickly.
15. Changes and contact
We may update these terms. If a change is material we will tell you by email or in the dashboard at least 14 days before it takes effect; using the Service afterwards means you accept it. Questions: support.
