Terms of Service

1. The agreement

These terms are between you (“you” or the “Customer”) and the operator (“we”, “us”), and cover the Ember Studio service at (the “Service”). By creating an account, or by using the Service, you agree to them and to our Privacy Policy. If you are using the Service for a company, you confirm you may bind that company. You must be old enough to enter a contract where you live, and use the Service for business purposes.

2. The service

The Service helps you improve how a local business appears in search. It includes:

Each plan has monthly allowances (for example images, AI generations and live lookups). Allowances are hard limits: when one is used up, that feature waits until the next period, or you upgrade. Unused allowance does not roll over. Where a plan lets you connect your own AI key or data-provider login, you are responsible for that account and its charges.

You keep all rights in the images you upload, the business information you enter, and the text and metadata generated for you. You give us only the permission we need to store, process and return that material to you, including sending it to the AI and data providers described in the Privacy Policy so the Service can work.

You confirm that you have the right to upload each image and to use the results, that you may manage or have permission to analyse any Google Business Profile you import, and that none of it infringes anyone's rights or is unlawful.

5. Acceptable use

We may suspend or limit an account that breaks these rules, after warning you where that is practical.

6. AI output, rankings and results

Titles, descriptions, categories, posts and other text are AI-generated suggestions and may contain mistakes. You are responsible for reading and approving everything before you publish it, and for making sure it is true about your business and complies with the rules of the platform where you post it (including Google's Business Profile content policies).

Search rankings depend on factors outside our control, including decisions by Google. We do not promise any ranking, traffic, calls or revenue. Audit scores and rank positions are estimates from third-party data at the moment of the check. We are not affiliated with, endorsed by or sponsored by Google, Facebook, Apple or any directory named in the Service.

7. Third-party services

The Service works with services we do not control - AI providers, a business-data provider, payment processors, blockchain networks, sign-in providers, geocoding services and the directories we list. Their availability, prices, terms and privacy practices are their own. Directory links are provided for convenience; a directory may change its address, price or rules, or reject a listing, without notice.

Where crypto is offered, you can pay with USDT on the TRON (TRC20) network, sent directly to the wallet address shown at checkout. Please read this carefully, because blockchain payments cannot be reversed.

10. Refunds

Fees are for access to the Service during the period paid and are not refundable for a partly used period, except where the law requires it or our payment partner's terms provide otherwise for card purchases. Crypto payments are final because they cannot be reversed; if we are unable to provide the Service you paid for, we will work with you on a fair remedy, such as extending your plan. If you think you were charged in error, contact us within 30 days and we will investigate.

11. Data retention and deletion

Images you upload and the files we produce are kept for the retention period of your plan (between 7 and 180 days, depending on your plan), and then deleted automatically. You can delete a job, and with it its files, at any time. Text generated by the GBP Optimizer, imported profile snapshots and your account records are kept while your account exists. Deleting your account removes your content; records we must keep for tax or legal reasons are retained as the law requires. You can export your results at any time; download what you need before its retention period ends.

12. Warranties and liability

The Service is provided “as is” and “as available”. We work to keep it reliable, but we do not promise it will be uninterrupted or error-free, and we exclude warranties that the law allows us to exclude.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, rankings, traffic, data or goodwill; and our total liability for anything arising from the Service in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

You agree to cover reasonable losses we suffer from a third-party claim caused by content you upload or by your breach of these terms.

13. Ending the agreement

You may stop using the Service and close your account at any time. We may suspend or end an account that breaches these terms, is used unlawfully, or has an unpaid balance after the grace period. When an account ends, your right to use the Service ends, and sections that by their nature should continue (such as liability, payment obligations and governing law) continue.

14. Governing law

These terms are governed by the laws of the country in which the operator is established, without regard to its conflict-of-law rules, and disputes go to the courts of that country - except that nothing removes any consumer-protection right you have under the law where you live. Please contact us first; most problems can be sorted out quickly.

15. Changes and contact

We may update these terms. If a change is material we will tell you by email or in the dashboard at least 14 days before it takes effect; using the Service afterwards means you accept it. Questions: support.

Privacy Policy

In short: we collect what we need to run your account and the tools you use, we send your images and business details only to the providers needed to produce your results, we never sell personal data, and we do not use your images to train AI models.

3. Signing in with Google, Facebook or Apple

If you choose one of these, we receive from that provider a unique identifier, your name and your email address (and, for Apple, possibly a private relay address). We use them only to create and secure your account. We do not receive your provider password, contacts or posts. You can instead use an email and password. The provider handles your data under its own privacy policy.

We do not sell personal data, and we do not use your images or business text to train AI models.

5. Who we share it with

We use these kinds of service providers, and give each only what it needs:

Some of these providers are in other countries, so your data may be processed outside where you live. We rely on contractual protections and the providers' own safeguards for those transfers.

7. Security

Passwords are stored only as salted hashes. Saved API keys are encrypted at rest. Connections use HTTPS, sign-in attempts are rate limited, and access to production data is restricted. No system is perfectly secure; if we learn of a breach affecting you we will tell you as the law requires.

8. Your rights

Depending on where you live, you can ask to access, correct, export or delete your personal data, to object to or restrict some uses, to withdraw consent, and to complain to your data-protection authority. Email us from your account address and we will respond within 30 days. You can update your details, delete jobs and remove saved keys yourself in the dashboard.

9. Cookies and similar storage

We use one essential cookie to keep you signed in, and a short-lived cookie while you sign in with Google, Facebook or Apple to protect that sign-in from forgery. Your light/dark theme choice is kept in your browser's local storage. We do not use advertising or cross-site tracking cookies. The sign-in providers may set their own cookies on their own pages.

10. Children

The Service is for businesses and is not directed to children. We do not knowingly collect data from anyone under 16; if you think we have, contact us and we will delete it.
